This Master Service Agreement & Contractual Terms and Conditions (hereafter referred to as the "Agreement") governs all digital operations, website usage, and field services provided by Goleta Pressure Washing (hereafter referred to as the "Company" or "Contractor") to the individual or entity authorizing work (hereafter referred to as the "Client"). "We," "us," and "our" refer to Goleta Pressure Washing, owner-operated by Grant Kahn, California Contractors License #1148367, serving Goleta, Santa Barbara, Montecito, and Summerland on the Santa Barbara South Coast. By approving a project estimate, quote, or work order through the Company's electronic management systems, using our website, or executing this document physically, the Client explicitly accepts and agrees to be legally bound by all terms, conditions, disclaimers, and operational parameters set forth below.
1. Scope of Services
1.1 Provided Services: Goleta Pressure Washing provides professional exterior cleaning and surface restoration services for residential and commercial properties, including but not limited to: roof cleaning and soft washing; house and exterior soft washing; driveway, patio, and concrete pressure washing; gutter cleaning; window cleaning; and commercial pressure washing. All services are performed by licensed and insured personnel using professional-grade equipment.
1.2 Scope Limits: Verbal requests for additional services made on-site must be formalized via a signed Jobber change order and will be billed additionally. This quote covers only the specific surfaces listed; any additional or unlisted structural areas require a separate, independent quote.
2. Booking, Deposits, Cancellations, and Site Lockouts
2.1 Non-Refundable Deposit: To secure an active service date, a ten percent (10%) non-refundable down payment is required upon approval of the quote. This deposit covers immediate administrative scheduling, routing costs, and upfront operational preparation.
2.2 Cancellation & Rescheduling: The Client may request to reschedule or cancel a service up to forty-eight (48) hours prior to the scheduled crew arrival time without further penalty. Cancellations or rescheduling requests made less than forty-eight (48) hours prior to the service window will result in the immediate forfeiture of the 10% deposit.
2.3 Lockout & No-Access Fee: If the Company arrives on-site at the scheduled time and is unable to access the property or safely perform work due to Client-controlled constraints — including, but not limited to: locked side gates, parked trailers, boats, or vehicles obstructing wash zones, construction materials, uncooperative tenants, Homeowners Association (HOA) intervention, or missing/inaccessible municipal water valves — a $150.00 site lockout fee will be billed immediately. The project must subsequently be rescheduled at the Client's sole expense.
3. Timelines, Estimates, & Emergency Interruptions
3.1 Project Duration Estimates: All timeframes, operational lengths, and arrival windows provided during quoting are professional, good-faith estimates. Massive residential or commercial scopes, heavy structural organic buildup, and localized environmental variables can cause project timelines to shift. Goleta Pressure Washing reserves the right to extend a project timeline as technically necessary to ensure a thorough, damage-free restoration.
3.2 Mechanical Breakdown & Crew Emergencies: In the rare event of severe mechanical equipment malfunction, crew injury, or an unforeseen crew family emergency mid-job, the Company will immediately pause work, notify the Client, secure the job site in a safe configuration, and reschedule to complete the remaining scope at the earliest available window. Such operational interruptions do not constitute a breach of contract and do not grant the Client the right to withhold payment for completed work.
3.3 Right to Decline / Safety Walk-Off: While the Company inspects properties during quoting, unforeseen structural safety hazards may become apparent only once work begins. Goleta Pressure Washing reserves the absolute right to decline, immediately halt, or alter any portion of the work that is deemed technically impossible, structurally unsound, excessively high, or dangerously unsafe for our technicians. This includes, without limitation, the sudden discovery of active stinging insect nests (such as bees, wasps, or hornets) or aggressive local wildlife. If a portion of the job is skipped for safety risks, the final invoice will be prorated to reflect only the work safely completed.
3.4 Force Majeure (Weather Constraints): Sudden extreme weather shifts — including, but not limited to: high winds causing uncontrollable chemical drift, torrential downpours reducing chemical cleaning efficacy, lightning, freezing temperatures creating icing hazards on hardscapes, or earthquakes — will result in an immediate pause of operations. Goleta Pressure Washing reserves the right to pause and reschedule without financial penalty or structural liability.
4. Mid-Job Termination & Stop-Work Clauses
4.1 Right to Collect for Partial Work: If the Client terminates services, experiences an unexpected personal emergency, revokes property access, or orders Goleta Pressure Washing technicians to stop work prior to 100% completion of the quoted scope, the Client is legally required to pay a prorated amount matching the exact percentage of work completed at that time. For example, if seventy-five percent (75%) of the project scope is complete, seventy-five percent (75%) of the gross quote amount is due and payable immediately.
4.2 Workspace Safety & Harassment: The Company reserves the right to suspend operations and exit the property immediately if our technicians encounter an unsafe, hostile, litigious, or volatile working environment — including verbal abuse or threats from unsecured household pets. In such cases, a prorated invoice for all work completed up to that moment will be issued immediately.
5. Property Damage, Pre-Existing Conditions, & Liability Limits
5.1 Verified Contractor Fault: Goleta Pressure Washing is fully licensed and insured. In the unlikely event that our technicians directly cause physical damage to your property due to explicit negligence (such as physically striking a light fixture or fracturing glass with an aluminum wand), our liability is strictly limited to the cost of repairing or replacing the specific damaged item, up to our liability insurance policy limits. The Company must be notified in writing within forty-eight (48) hours of job completion to inspect and remedy the verified issue.
5.2 No-Fault / Pre-Existing Damage / Exposed Defects: Surface dirt, heavy mold, and thick organic growth can effectively conceal severe pre-existing property degradation. Goleta Pressure Washing is not liable for any damage or aesthetic flaws exposed by cleaning, including, but not limited to: pre-existing structural wood rot, failed insulated window glass seals (resulting in post-wash interior fogging), sun-baked paint that flakes or peels under normal wash pressure, loose or degraded vinyl siding, crumbling stucco, oxidized material patterns, or deteriorated caulking/trim that detaches during standard rinsing.
5.3 Hidden Subsurface Hazards: The Company is not liable for damage to unmarked or improperly buried landscape elements, including, but not limited to: shallow irrigation lines, unanchored landscape lighting, unmarked sprinkler heads, or invisible dog fences caught or moved by standard commercial hoses.
5.4 Water Intrusion Disclaimer: The Company takes extensive preventative protection measures (such as custom-taping and bagging vulnerable exterior electronic assets). However, if the property features faulty door weatherstripping, unsealed window frame perimeters, or open attic, pet, or garage doors, water intrusion may occur. The Client agrees to hold Goleta Pressure Washing harmless for interior water damage arising from structural defects, unsealed openings, or open access paths.
5.5 Third-Party & Neighbor Liability: The Client assumes all liability for localized chemical drift or neighbor communication regarding shared boundaries. Damage caused to property or equipment by independent outside entities (such as delivery trucks, neighborhood children, or independent contractors) while we are on site is strictly a matter between the Client and that third party. Unauthorized third-party repairs attempted on alleged contractor damage prior to an official inspection by Goleta Pressure Washing instantly void any and all liability on our part.
6. Physical Injuries, Chemical Overspray, & Safety Zones
6.1 Worksite Safety Zone: High-pressure equipment, chemical routing, and active wash zones create a strict hazard area. The Client, their family, guests, tenants, and pets must remain completely clear of the work area while equipment is active. Goleta Pressure Washing is not liable for slips, falls, or physical injuries sustained by any individual who enters a wet, soapy, or active treatment zone.
6.2 Chemical Overspray & Pedestrian Awareness: Goleta Pressure Washing utilizes professional-grade sodium hypochlorite (bleach) surfactant matrices to sanitize and clean exterior surfaces. This chemical instantly discolors and damages fabrics, apparel, and personal property upon contact. The Client is strictly responsible for notifying all household members, guests, tenants, and visitors to completely avoid active wash areas. Goleta Pressure Washing is not liable for damage to apparel, footwear, or personal items worn or carried by any individual who enters an active work zone or approaches a technician while equipment is operating.
6.3 Technician Injuries: Goleta Pressure Washing complies with all standard safety protocols. The Client is held completely harmless for any operational injuries sustained by our technicians on the property, provided the injury was not caused by a hidden, undisclosed property hazard (such as a rotten deck step or an unstable roof structure that the Client failed to warn us about).
7. Payment Terms & Legal Remedies
7.1 Payment Terms: Payment is due immediately upon completion of the work. Goleta Pressure Washing accepts credit cards, debit cards, checks, Zelle, Venmo, and cash (with a standard discount applied for cash payments). Unexpected post-clean expectations regarding permanent stains (such as oil, rust, acid burns, or artillery fungus) do not validate withholding final payments.
7.2 Collection Actions & California Mechanic's Liens: If the Client refuses to pay for fully or partially completed work, Goleta Pressure Washing will pursue all legal remedies to recover the debt. This includes applying a 1.5% monthly finance charge on outstanding balances, submitting the account to a collections agency, and filing a formal California Mechanic's Lien against the property's title for non-payment under California civil mechanics lien laws.
8. Utilities, Site Interference, & Preparation Requirements
8.1 Water Supply Access: Goleta Pressure Washing requires hookup to working, accessible outdoor water spigots to feed our equipment's water buffer tanks. The Client must ensure exterior water valves are turned on and functioning prior to our arrival. The Client assumes all liability for well-pump depletion or standard high-volume utility usage; turning off water mid-job holds the Client financially liable for any resulting dry-running pump damage to our commercial equipment. Goleta Pressure Washing does not require on-site electrical utility power.
8.2 Site Interference: The Client agrees to clear all small items (cushions, doormats, toys, small potted plants) and vehicles from the wash zones prior to our arrival. GPW technicians will gladly assist in moving heavy patio furniture safely. Interference from concurrent third-party contractors (such as landscapers, painters, or roofers) that disrupts our workspace, dilutes applied chemicals, or re-contaminates fresh surfaces may result in operational delay fees or prorated job completions.
9. Cleaning Methodologies & Material Realities
9.1 Soft Washing vs. High Pressure: We utilize a low-pressure Soft Washing process combined with biodegradable surfactants to safely kill algae, mold, and dirt at the root on siding, stucco, paint, and roofs. High pressure is strictly reserved for hardscape concrete surfaces like driveways. Standard bleaching odors are natural bi-products of organic material breakdown and dissipate quickly.
9.2 Standard Window Rinse Only: If the project scope is for a House Wash or Roof Wash only and does not explicitly include a dedicated Window Cleaning service, the detergents used to clean your siding or roof will inevitably run down across exterior windows. While we perform a thorough rinse, Goleta Pressure Washing is not responsible for hard water spots, soap residue, or water marks left on the glass as it air-dries. Professional exterior window cleaning can be added to your package prior to the service date upon request.
9.3 Post-Service Environment: Goleta Pressure Washing is not responsible for environmental contamination (such as tree sap, pollen, heavy dust storm settlement, or bird droppings) that occurs on freshly cleaned exterior structural surfaces or glass once our crew has completed the service and departed the property site.
10. Website Use & Intellectual Property
10.1 Intellectual Property: All content displayed on https://goletapressurewashing.com — including text, website copy, graphics, logos, custom graphics, and photographic before-and-after imagery — is the exclusive property of Goleta Pressure Washing and is protected by United States copyright laws. Unauthorized reproduction, scraping, or copying of our media assets for commercial use is strictly prohibited.
10.2 Disclaimer of Website Warranties: Our website is provided "as is" and "as available" without warranties of any kind, express or implied. While we endeavor to keep digital information accurate and current, the Company disclaims liability for temporary technical website downtime, errors, or typographical inaccuracies regarding service descriptions.
11. Governing Law & Dispute Resolution
11.1 Jurisdiction: This Agreement and all issues arising out of or relating to our website or our field services are governed entirely by the laws of the State of California, without regard to its conflict-of-law principles. Any legal dispute or claim will be resolved exclusively in the state or federal courts located in Santa Barbara County, California, and the Client explicitly consents to the personal jurisdiction of those local courts.
12. Changes to These Terms
12.1 Updates: We reserve the right to modify or update these Terms from time to time. When updates occur, we will revise the "Effective date" at the top of this page. Continued use of our website or procurement of our field services after changes go into effect constitutes explicit acceptance of the revised Agreement.
Client Acknowledgement & Execution
By checking the approval box in the electronic portal accompanying this quote, I acknowledge that I have read, understood, and accepted all terms, conditions, and disclaimers outlined in this twelve-section Agreement. I verify that all exterior doors and windows will be sealed, gates unlocked, vehicles moved, and utilities turned on prior to the arrival of the Goleta Pressure Washing crew.
